三方协商机制是多元社会中协调劳资双方利益冲突的一项基本制度,为世界各国所普遍采用,也是国际劳工组织长期推行的国际劳工标准之一。三方协商机制在今日的中国具有其他制度无法取代的作用。我国虽然已经在国家和地方层面建立起了协调劳动关系的三方机制,迈出了走向社会对话的第一步,但其作用受到了普遍质疑,仍需要借鉴国外的经验教训进行必要的改革,以逐步形成具有中国特色的劳动关系三方协商机制。
工资集体协商制度作为协调劳资双方利益关系、维护劳动者经济权益的重要机制,其产生与发展受到了强制性制度变迁与诱致性制度变迁的双重影响。经过多年的探索和实践,我国的工资集体协商制度得到了广泛发展,但协商效果并不是非常理想,根本原因在于相关法律法规缺位、协商主体不成熟、推进动力倒置等制度性障碍。进一步对现行工资集体协商构架进行必要的制度创新和制度完善,是构建和谐劳动关系、维护社会稳定的重要保证。
